IMAGE USAGE TERMS & CONDITIONS
Please find below for your convenience our image usage terms and conditions. This applies to any image captured by the Lovely Creatures Brand.
We have also attached these image usage terms to an attachment should you wish to print them out.
LICENCE AGREEMENT TO USE IMAGES SUPPLIED BY Lovely Creatures & ASSOCIATED BRANDS.
IT IS IMPORTANT YOU READ THE FOLLOWING TERMS AND CONDITIONS OF THIS LICENCE AGREEMENT (YOUR LICENCE) CAREFULLY BEFORE USING THE ASSOCIATED IMAGES SUPPLIED
Images supplied by a photographer are protected by the Copyright, Designs and Patents Act 1988 and other legislation, and a breach of copyright law is a SERIOUS OFFENCE.
By receiving any images [or any previous images] supplied by Lovely Creatures, you acknowledge your acceptance of the terms of this Licence and you agree to be bound by its terms and conditions.
Any failure to comply with the terms of this Licence may be dealt with as a copyright infringement.
The Licensed Images are supplied in either ‘High Resolution’ or ‘Low Resolution’ formats digitally via a secured online gallery.
Lovely Creatures grants you a non-exclusive, non-transferable, licence to use the supplied Images, identified above, in the following ways -
The images have been resized to be suitable for most online websites and may be used for display on websites, prints, social media or any such medium providing the following criteria are met. These images have a small watermark on them to allocate accreditation to (Lovely Creatures) which must remain on them.
If images are given without a watermark for use on your website or other promotional use you must give a backlink to our website and credit whenever they are used. (Lovely Creatures) www.lovelycreatures.co.uk
If images are used on Instagram they must tag @WeAreLovelyCreatures
If you wish to backlink to our website it would be much appreciated and we are happy to do the same for you if requested. www.lovelycreatures.co.uk
Any images used in blog features must backlink to www.lovelycreatures.co.uk
Every image used MUST be credited to Lovely Creatures whether that be on social media, your website, in a brochure or any time an image is used that is from Lovely Creatures it must clearly be tagged and credited.
Failure to adhere to these simple guidelines will result in the images being required to be taken offline if no credit is added within 24hrs.
Failure to comply within 24hrs will result in an invoice being raised for £350 per image and per-instance used + 10% of the total for each week that this invoice remains unpaid.
Unfortunately, these image usage terms and conditions are legally binding and enforceable for unlicensed usage as it is theft and breaches the copyright act.
For the purposes of this Licence Agreement, the images provided do not include use that results in financial gain (including but not limited to: advertising, stock photography, print sale profits, or resale of any nature). It also excludes use for other commercial or editorial purposes, as well as competition use without the express written permission of Lovely Creatures.
It is not permitted to alter or adjust any of the High or Low-Resolution images or add filters in any way without the express written permission of Lovely Creatures
The above permissions apply worldwide.
Your purchase of the original files releases Lovely Creatures from any liability due to loss or damage of the images and releases Lovely Creatures from any obligation to maintain copies of any digital file, image, or photograph.
All rights, title and interest in the Licensed Images, including (without limitation), all copyright, patent, trademark, rights of publicity and other proprietary rights, are owned and shall remain with Lovely Creatures
This information is private and confidential.
By using any of the Lovely Creatures brands images you are accepting these images and you are agreeing to the above Licence and its Terms & Conditions.
This Licence Agreement is governed by English law and shall fall under the Exclusive Jurisdiction of the Courts of England and Wales.
